Introduction

www.stylediva.co.za ("the site") is the online e commerce storefront of Jet Music (Pty) Ltd trading as StyleDiva, registration # 2010/022928/07. Our registered offices are 284 Oak Avenue, Randburg 2194, Gauteng, South Africa.

Acceptance

All users and customers that use this site are bound by these terms and conditions ("T's & C's) By registering, or using the site in any way or platform, you agree that you've read and accepted these terms and conditions. These T&C's come into effect one published on the Site and continue until such time as the Site is no longer active. These terms and conditions in no way affect your statutory rights. No other terms or conditions shall be binding unless agreed to by StyleDiva in writing.

StyleDiva reserve the right to amend these T&C's at any time, which shall be posted on the Site. These T&C's come into effect from the time they are posted on the Site. You should ensure you are up to date with any amendments. In the event you no longer agree with the T&C's on the Site you should immediately refrain from using the Site and placing any further orders on the Site.

If any clause in these T&C's or transaction becomes or is declared by any court of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall in no way affect any other clause or part of any clause, all of which shall remain in full force and effect, so long as these T&C's or transaction shall be capable of continuing in effect without the unenforceable term.

Communication

When you visit the Site or send e-mails to StyleDiva, you agree to receiving electronic communications from StyleDiva and agree that all agreements, notices, disclosures and other communications sent by StyleDiva satisfy any legal requirements, including but not limited to the requirement that such communications should be in “writing”.

Copyright

These Terms and Conditions belong to StyleDiva, a division of Jet Music (Pty) Ltd and may not be used, extracted or referred to by third parties for non commercial or commercial use. Any infringements may result in legal action.

Legal Capacity

All customers who place an order on the site warrant that they are 18 years or older and have a legal right to use the credit or debit card used to place the order.

The Transaction

You are able to place an electronic order for one or more products listed as available on the site whilst the products are listed as available and are not sold out. You can place the order after registering for the site or you may complete the order as a Guest. Transactions placed as a Guest will not be able to be viewed on account history if you register at a later date.

A sale contract between you and StyleDiva comes into effect once you have completed the checkout process for one or more products in your shopping cart, and the payment has been authorized by our designated payment gateway. A sale contract is not completed if the goods remain in the shopping cart or payment has not been authorized. Goods which become out of stock during the shopping process will be removed from the shopping cart during checkout and StyleDiva is not obliged to deliver the products which have become out of stock.

The product price listed on the shopping cart during checkout is the final price of an item. No other advertised or communicated price shall be valid for the transaction. In the event of an incorrect price, StyleDiva reserves the right to advise you of such and cancel the ordered product(s) with the incorrect product price.

StyleDiva attempts to ensure stock levels are correct at all times. In the event StyleDiva is unable to fill a completed order because the item is out of stock, StyleDiva is not obliged to supply the ordered product at the advertised or order price. Customer service will advise you of the out of stock and offer a refund for the ordered product(s) which are out of stock.

The sale contract becomes binding once an order confirmation has been sent by StyleDiva. A copy of the invoice will be placed in the parcel shipped and will be available in account history for a period of 12 months, following which account invoices will no longer be available on account history.

Cancelling a Transaction

StyleDiva reserves the right to cancel any transaction partially or completely or to refuse payment of such transaction with written notice to you. StyleDiva will be liable to refund the transaction rand total to the card used during checkout if the transaction has been paid for.

You have the right to cancel an order or to return items purchased as set out under StyleDiva's Delivery and Returns Policy. If you discover you have made a mistake during the checkout process, please contact customer service on [email protected] or call the customer care line on 086 555 5555.

Transaction Price

The price of each product is listed on the product page for a specific style colour and/or length. Prices may vary between colours and lengths. The price is displayed on the product page once a colour and/or length has been selected on the product page.

In some cases, for a specific style a colour or length may be on sale or special offer and not for other colours or lengths, in which case the sale price will be listed for that specific colour or length only. StyleDiva will not be obliged to offer that sale or special offer price for other colours or lengths not on sale or special offer. The sale or special offer price will be the price listed on the product page once a colour and/or length has been selected on the product page and is not subject to a further discount on checkout.

StyleDiva attempts to ensure prices and delivery charges are correctly displayed on the site and at checkout, however if a product is listed at an incorrect price or order at an incorrect delivery charge, StyleDiva is not obliged to supply the products at the incorrect price or order at incorrect delivery charge. In the event of an incorrect product price or order delivery charge, customer service will contact you to advise of the error and correct product price or order delivery charge. StyleDiva will only be liable to refund you the original payment made on checkout in the event you decline to accept the correct product price or order delivery charge.

Transaction Payment

The site only accepts Visa and MasterCard credit and debit cards as forms of payment at this time. An order placed on the site will only be completed once authorization from the bank is received for the payment. Failure to receive authorization for the payment will result in the order not being completed.

You warrantee that you are properly authorized to use the credit card for payment of your order placed on the site and that sufficient funds are available at time of checkout.

Out of Stock

StyleDiva attempts to ensure stock levels are correct at all times. In the event StyleDiva is unable to fill an order because the item is out of stock, StyleDiva will not be obliged to supply the ordered item at the advertised or order price. Customer service will advise you of the out of stock and offer a refund for the ordered item(s) which are out of stock.

Security

Any person who attempts to or downloads any unauthorized code to the site, or attempts to or gains unauthorized access to the site will be face criminal proceedings and civil proceedings for any resultant damages or loss StyleDiva may incur as result of the unauthorized access or code.

You agree and warrant that your log in user name and password is for your personal use only and shall not be disclosed to any third party

All credit card transactions on the site are protected by SSL (Secure Socket Layer) encryption StyleDiva's registration documents and the registered domain name are verified and underwritten by Thawte.

Disclaimer

StyleDiva is required to comply with the Consumer Protection Act 68 of 2008 with the sale of any products from the site, and the Electronic Communication and Transactions Act 25 of 2002 with respect to payment systems and security.

Neither StyleDiva nor any of its agents or representatives shall be liable for any damage, loss or liability of any kind that from the use or inability to use this site or the services or content provided from and through this Site. Furthermore, StyleDiva makes no representations or warranties, implied or otherwise, that, amongst others, the content and technology available from this Site are free from errors or omissions or that the service will be 100% uninterrupted and without error. Although the products on the site may be under warrantee, the site itself is offered on an "as it is" basis and is not set up or customized to meet your individual specifications. Information, ideas and opinions expressed on the Site should not be regarded as professional advice, or the official opinion of StyleDiva. Applicable Laws

This site is offered, controlled and run from the Republic of South Africa. As such it is governed by South African legislation, and subject to the disputes clause in these Ts & Cs. You and StyleDiva are subject to the non-exclusive jurisdiction of the South African courts. All sections of these terms and conditions must be read as individual and separable from the rest of the terms and conditions. Should any court or qualified authority find that any section of part thereof of the T&C's are invalid or unenforceable, the remainder of the T&C's will remain standing, despite invalidity or unenforceability of any other section or part thereof.

Privacy

StyleDiva has to take all reasonable steps to protect your personal information. For the purpose of this clause, "personal information" is defined according to the details in the Promotion of Access to Information Act, number 2 of 2000 (PAIA).

When you create an account on the Site, StyleDiva may collect, store and use the following personal information:

• Delivery address
• Non-personal browsing and click patterns
• Email address

• and ID or passport number

The personal information collected may be used for the following purposes:

• To deliver the products purchased on the Site
